At ElementKits, we respect intellectual property rights and expect our users to do the same. This Copyright and DMCA Policy outlines how we handle claims of copyright infringement and explains the process for submitting a DMCA takedown notice or counter-notice.

By using our website and purchasing products, you agree to comply with our copyright policy and respect the rights of copyright holders.

1. Copyright Ownership

All content available on ElementKits, including but not limited to digital products such as themes, templates, addons, images, videos, and written materials, are protected by copyright laws. The intellectual property rights for these products belong to the original creators, whether developed by Element Studio Philippines or third-party developers and partners.

For third-party products, intellectual property remains with the respective creators who have granted us the license to distribute their products under our terms.

2. Reporting Copyright Infringement (DMCA Takedown Notices)

If you believe that any content available on ElementKits infringes your copyright, you can submit a DMCA takedown notice to request the removal of the infringing content. A valid DMCA notice must include:

  • Your contact details (name, address, email, and phone number).
  • A description of the copyrighted work you believe has been infringed.
  • A description of the infringing content and its location on our website (URL).
  • A statement that you believe in good faith that the content is infringing upon your copyright.
  • A statement made under penalty of perjury that the information provided is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  • Your signature (physical or electronic).

Once we receive a valid DMCA notice, we will act promptly to remove or disable access to the infringing content.

3. Counter-Notices

If your content was removed due to a DMCA takedown notice and you believe the removal was made by mistake or misidentification, you can submit a counter-notice to restore the content. A valid counter-notice must include:

  • Your contact details (name, address, email, and phone number).
  • A description of the removed content and its location prior to removal.
  • A statement under penalty of perjury that the content was removed by mistake or misidentification.
  • Your signature (physical or electronic).

Once we receive a valid counter-notice, we will review the request and restore the content unless the original claimant submits legal action within 10 business days.

4. Repeat Infringers

ElementKits reserves the right to suspend or terminate the accounts of users who repeatedly infringe on the intellectual property rights of others. If we determine that a user is a repeat infringer, we may permanently remove their access to our platform.

5. Limitation of Liability

ElementKits is not responsible for any content uploaded or posted by third-party users. We act as an intermediary platform for digital products, but the responsibility for ensuring that the content complies with copyright laws lies with the users and content creators.

6. Changes to Copyright and DMCA Policy

ElementKits reserves the right to update or modify this Copyright and DMCA Policy at any time. Any changes will be posted on this page with an updated “Last Updated” date. We encourage you to review this policy periodically to stay informed about how we manage copyright issues.
