1. General Terms

1.1 Ownership and Intellectual Property

All products available on ElementKits, including but not limited to themes, templates, plugins, addons, and related assets, are protected by copyright and other intellectual property laws. The intellectual property rights of these products belong to their respective creators or owners.

• ElementKits Products: For products developed and distributed directly by ElementKits, the intellectual property rights remain with ElementKits. You are granted a limited license to use the products in accordance with the terms of our licenses (Regular or Extended), but the ownership of the product itself stays with ElementKits.
• Third-Party Products: For products created by third-party developers, intellectual property rights remain with the original creators. ElementKits offers these products for use in line with the applicable licensing terms, and you are granted a limited right to use them as per the chosen license type.

In either case, all products are licensed to you for use within the specified scope of the license, and no ownership rights are transferred. You may not claim ownership, reverse engineer, or redistribute the products unless explicitly allowed by the license.

1.2 Superseding Terms

The terms in this License Policy may be superseded by specific terms mentioned in the product page description. If different licensing terms, usage rights, or restrictions are specified on the product page, those terms will take precedence over the general terms of this policy for that product. This applies to both Regular and Extended Licenses. Please review each product page for additional or overriding terms.

2. Regular License: Standard Item or Pro Service

This license offers two key options to cater to different needs: Standard Item and Pro Service. These options are designed to provide flexibility, whether you're seeking ready-to-use digital products or specialized, hands-on services to enhance your website. Choose a Standard Item for a quick and easy setup, or opt for a Pro Service to access tailored, expert solutions. Each option is crafted to help you achieve your goals with efficiency and effectiveness.

Standard Item refers to downloadable products or items linked to external sources, including both free and premium options. These items typically consist of pre-made templates, plugins, or digital assets that are readily accessible and can be used directly by customers.

Pro Service, on the other hand, includes specialized services beyond basic product installation. These services are tailored to meet specific needs, such as custom development, SEO setup, website optimization, and ongoing support. Pro Services are designed to provide more personalized and advanced solutions for your site.

2. Regular License: Template Installation Only

The Regular License grants you the right to use our products in a single personal or commercial project. This License is designed for customers who need the template to be installed exactly as seen on the demo site with customization to designs based on the template you purchase. This license grants you the right to request our one-time installation service, where we set up the template for you as shown in the demo site.

2.1 Usage Rights

• Single Project Use: The product can be used for one project only, whether that be a personal website, a client project, or a business website, or other small-scale commercial applications. 
• Modification and Customization: After we have set up the template as shown on the demo site, you are free to modify, customize, and integrate the product as needed for your specific project. This allows you to adjust the design, functionality, and content to fit your requirements. Please note that our service is limited to the installation of the template only, and any further modifications are your responsibility to handle as a DIY project.
• No Customization Beyond Demo: The Regular License includes template installation exactly as it appears in the demo, but customization service is not included. The product is delivered exactly as shown, with no modifications, additional design changes, or adjustments.

2.2 Limitations

• Single Project Only: The product may only be used for one project (one domain or one client). If you wish to use the product in multiple projects, additional licenses will need to be purchased.
• No Redistribution: The product cannot be resold, redistributed, or sublicensed to others. It is licensed solely for your use in the project it was purchased for.
• No Free or Paid Distribution: The product cannot be included in a collection, bundle, or as part of any free or paid offering, whether online or offline, without prior written permission. This ensures that the integrity and value of the product are preserved.

3. Extended License: Website Customization

The Extended License provides you with the right to use our product in a single personal or commercial project. This license includes a one-time installation service where we set up the template exactly as seen on the demo site. Additionally, we’ll customize the design and add features within the template’s original layout. Please note, layout customizations are not included—customizations will be based on the existing template structure to ensure a streamlined and professional result.

3.1 Usage Rights

• You are granted the right to use the product in a single personal or commercial project.
• The product will be customized based on the purchased template, including design adjustments and the addition of features within the original template layout.
• You are entitled to a one-time template installation service, where we set up the template exactly as seen on the demo site.
• Customizations will be made to the template’s design and functionality, without altering the original layout.

3.2 Limitations

• No custom layout changes are permitted; customizations are limited to design and feature adjustments within the existing template structure.
• You cannot redistribute, resell, or transfer the product to third parties.
• The product is only valid for the specific project for which the extended license was granted.
• Support for any changes outside the scope of the template-based customization is not included.
• Ongoing modifications or updates to the template after installation are not covered under this license. Separate arrangements will be required for any ongoing modifications or updates after installation.

Note: Once the template is installed and customized, any future changes, updates, or additional modifications to the template are not covered under this license. However, we offer a complementary maintenance service that covers minor changes such as replacing images and text, and keeping the site in good health. 4. Third-Party Products

Some products available on ElementKits are developed by third-party creators. While these products are provided to you under the same license terms (Regular or Extended) as ElementKits products, they may come with additional terms and conditions set by the original creators.

4.1 Ownership

The intellectual property rights for third-party products remain with the original creators or developers. By purchasing or downloading these products, you agree to adhere to their specific licensing terms, which generally align with the terms offered by ElementKits. However, the third-party creators may impose additional restrictions or requirements for use.

4.2 Support

Support for third-party products is managed directly by the original developers. While we aim to assist where possible, any technical issues, inquiries, or requests for support regarding these products should be directed to the creators. If you need assistance in finding the appropriate support channels, feel free to reach out to us on Telegram, and we will guide you to the proper support resources for third-party products.

5. Prohibited Use

Regardless of your license type, the following uses are prohibited:

• Reselling: You cannot resell or redistribute the product unless explicitly allowed in the product page description.
• Repackaging: You cannot repackage or combine the product to create new standalone products unless explicitly stated in the product page description.
• Illegal or Harmful Content: You may not use the product for illegal activities, violence, hate speech, or harmful/discriminatory content.

6. License Violations

To maintain the integrity of our offerings and the rights of all users, it’s important that our License Terms are followed. If you decide to upgrade your license, you will need to purchase the upgraded license at the full price. We recommend reviewing the different license options carefully before making your purchase to ensure you choose the best option for your current project needs.

8. Refund Policy

We offer a 5-day refund policy for products that have not been downloaded or used. If you experience any issues, we encourage you to reach out to us first—we’re here to help and will make every effort to resolve your concerns before considering a refund.

Please note: Refunds may not be available for products that have been downloaded or accessed. However, if you are facing difficulties with the product, please contact us via Telegram.
